Companies suing the government for taxes that they just pass on to consumers is both the bread and the circuses of the modern age.
I think that Nintendo did not pass on the tariff to consumers in this situation meaning that they have literal monetary damages. At least, that’s the rumor.
Switch 2s are cheaper in America than the Eurozone and the EU aren’t putting any new tariffs on Japan or Viernam, so they haven’t increased prices to account for tariffs. They pulled this off by getting a whole lot of Switch 2s into America before tariffs came into force.
Isn’t that because EU prices include VAT?
I think Nintendo knows how important the US is to their bottom line so they’re willing to eat some shit before making a buck.

I think it‘s past 2000 at this point and growing. This is huge.
It’s big, but it’s not really impressive. It’s just for restitution, because the tariffs were already ruled illegal. This is just suing to see how much will be returned. It’s interesting, but it doesn’t effect much. It’d be nice if the money went to the consumers that paid the increase in prices, but we know that isn’t going to happen.
